Distance sales contract

[EXPERT REVIEW REQUIRED] This is a working draft for transparency. It is not legal advice; a qualified professional must review it before it is treated as final and binding.

This contract is concluded remotely between the seller and the customer for web design services ordered online. It applies to services only — Digital Startuper sells no physical goods.

1. Parties

Seller: İbrahim Etem Karakaya — sole proprietorship operating the brand “Digital Startuper”, Türkiye. Full contact details are published on the contact page.

Customer: the person or entity placing the order via the order email or payment link.

2. Subject and scope

The subject is the design and delivery of a website (from the template library or custom) as described in the written quote accepted by the customer. The scope, pages, features, timeline and price of each project are set in that quote; the quote prevails where it differs from this page.

3. Ordering process

  • The customer describes their need; we return a written scope and quote.
  • The order becomes binding when the customer accepts the quote in writing (email is sufficient).
  • Payment is made through a payment link provided by our payment provider. Cards of international origin are accepted subject to the provider’s rules.

4. Price and payment currency

Quotes are issued in US dollars (USD) for international customers; the payable amount and currency shown on the payment link are confirmed at checkout. Payments processed by our payment provider are settled to us in Turkish lira (TRY) at the provider’s applicable exchange rate. Any bank or currency conversion costs on the customer’s side are borne by the customer.

5. Performance and delivery

Work starts after payment (unless the quote states otherwise). Delivery is electronic, in the stages described in the quote — see delivery & refunds. No physical shipment or cargo is involved.

6. Right of withdrawal

Customers may have a statutory right of withdrawal within 14 days for distance contracts. For services that begin with the consumer’s prior express consent and acknowledgement that the right of withdrawal is lost once performance has begun, the applicable exceptions under Turkish Law No. 6502 are reserved. The exact scope of withdrawal and refund for each project is described in delivery & refunds.

7. Warranty and liability

The service is performed with due care; defects in the delivered work are corrected within a reasonable time at no extra cost. Liability is limited to the project price, except where mandatory law provides otherwise.

8. Complaints and dispute resolution

Apply in writing to the contact details. Consumers may apply to the competent Consumer Arbitration Committees and Consumer Courts under Turkish law.
